Terms of Use

These Terms of Use govern your use of the MomentPack mobile app and website, including the page where a Pack is opened. MomentPack is operated by Niko Ng in Vietnam. By collecting moments, publishing a Pack, sending a link, or opening one, you agree to these terms.

License to use MomentPack

Subject to these terms, MomentPack grants you a personal, non-exclusive, non-transferable, revocable license to use the app and website to collect moments, publish Packs, send them, and open them. You may not copy, modify, reverse engineer, distribute, scrape, or use the service in a way that violates applicable law or another person’s rights, and you may not attempt to enumerate, guess, or brute-force share links belonging to other people.

Your Pack content

You are responsible for the photos, titles, sender name, messages, notes, dates, place names, and other content you put into a Pack. You are responsible for having the rights to share those photos, including of other people. Do not send content that is unlawful, harassing, abusive, infringing, or otherwise inappropriate, and do not use MomentPack to send unsolicited bulk messages. You retain ownership of your content; you give us permission to process it only as needed to store your Packs, deliver them to the people you send them to, and operate the service.

Your collection stays on your device until you publish. Publishing sends the photos and words you approved for that Pack. A published Pack stays as it was sent. To change it, publish a new Pack.

Share links, sending, and opening

When you publish a Pack, MomentPack creates a share link containing a long random token. You choose how that link is delivered, and you are responsible for sending it to the right people. Share links do not expire on their own. When a Pack is turned off or deleted, the link stops opening it. Turning a link off does not retrieve a Pack someone has already opened, or a photo they have already saved. A photo address handed to the opening page lasts about a minute, and during that minute it can still be used.

Pasting the link into a chat can show a preview of the Pack title, the sender name, a short excerpt of the message, the cover, and the number of cards. Card photos and card notes stay out of that preview. A chat app may keep a preview it has already fetched after the link is turned off.

A Pack records when someone other than the sender first tears it open, and the sender can see that time. The sender also sees reaction counts and replies when responses are left on. A recipient can replace their own reply from the same browser. We do not promise that a reply can be deleted, and replacing it does not unsend a reply the sender has already read.

If you received a link, you may open the Pack and, when the sender has allowed it, leave a reaction or a reply. Do not use a link that was not shared with you.

Objectionable content and reports

MomentPack does not allow content that is sexually explicit, violent, hateful, exploitative, threatening, harassing, or otherwise unlawful. This includes photos as well as titles, notes, messages, and replies. We may refuse, remove, or turn off content that violates these rules or that we reasonably believe could harm someone or the service.

If a Pack is not kind or safe, email us at the address below and include the share link. We use the link to find the Pack and review it.

Availability and changes

We may update, change, suspend, or discontinue parts of MomentPack at any time. We aim to keep the service available and your published Packs intact, but do not guarantee uninterrupted operation, error-free performance, that a share link will remain openable indefinitely, or that a Pack will always be recoverable. Keep your own copy of anything you cannot afford to lose.

Disclaimers

MomentPack is provided on an “as is” and “as available” basis. To the extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. MomentPack is a way to send memories with a little ceremony. It is not a secure, confidential, or guaranteed-delivery channel, and you should not use it for sensitive information such as credentials, financial details, or health records.

Limitation of liability

To the extent permitted by law, MomentPack and Niko Ng will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost Packs, data, profits, goodwill, or business opportunities arising from your use of the service, including a Pack that fails to deliver, is opened by the wrong person, or is opened at a time you did not intend.

Termination

You may stop using MomentPack at any time. We may suspend or end access to the service, and may turn off share links, if we reasonably believe these terms have been violated or if doing so is necessary to protect the service, users, or others.

Governing law and changes

These terms are governed by the laws of Vietnam, excluding conflict of law rules. We may revise these terms from time to time. Continued use after a revised version is posted means you accept the updated terms.
